ELLIOTT GREENLEAF DEFEATS CONDITIONAL CERTIFICATION UNDER FLSA

As profiled in Employment Law 360, the United States District Court for the Eastern District of Arkansas denied conditional certification of a collective action brought against Elliott Greenleaf’s client pursuant to the Fair Labor Standards Act challenging overtime pay. The Court denied the Motion for Conditional Certification finding that the Plaintiff representative could not show that he was similarly-situated to other employees. As the representative could not meet this standard of FLSA at this time, the Court agreed with Elliott Greenleaf and denied the Motion for Conditional Certification.

Elliott Greenleaf’s client in this matter is represented by the Firm’s shareholders Eric J. Bronstein, Colin D. Dougherty and associate Gregory S. Voshell.
