ELLIOTT GREENLEAF HOSTS PATENT LAW ROUNDTABLE ON "HOT TOPICS IN THE PARALLEL UNIVERSE OF PATENT REEXAMINATION AND PATENT LITIGATION

On March 26, 2010, Elliott Greenleaf, in conjunction with the Intellectual Property Litigation Committee of the ABA Section of Litigation ("ABA-IPL"), hosted a patent law roundtable in the Firm's Wilmington office at 12:30 p.m. on "Hot Topics in the Parallel Universe of Patent Reexamination and Patent Litigation." The roundtable was moderated by Kenneth (Ken) L. Dorsney, head of the Intellectual Property Department of Elliott Greenleaf's Delaware office. The many participants in the roundtable discussed the debate about the increasingly complex issues that arise when patents are litigated concurrently with reexamination proceedings before the United States Patent and Trademark Office. Topics for consideration included ex parte and inter partes reexamination, the length of reexamination, multiple reexamination proceedings, establishing a substantial question of patentability in reexamination when relying on previously cited art, staying litigation pending reexamination, meeting the duty of disclosure in reexamination while complying with protective orders in litigation, reexaminations and willfulness, and In re Bilski impact on subject matter patentability challenges in reexamination.
