Elliott Greenleaf WINS SUMMARY JUDGMENT ON WAGE PAYMENT AND COLLECTION LAW CLAIM

Elliott Greenleaf won summary judgment on behalf of four United Kingdom-based corporate officers who were sued in their individual capacities by a former employee seeking damages and attorneys fees under Pennsylvania's Wage Payment and Collection Law ("WPCL").

A former superintendent of a mining company who, during the course of his employment, was provided a company paid life insurance policy with a guaranteed cash surrender value payable at the end of his employment, filed the lawsuit after the company filed bankruptcy, claiming that since the bankrupt company did not pay him, the individual corporate officials were liable under the WPCL.

Elliott Greenleaf argued that while the WPCL may impose individual liability in certain circumstances, it has no application when the claim arises post-bankruptcy because the individuals had no discretion or authority to make any post-petition payments. The Luzerne County Court of Common Pleas agreed with Elliott Greenleaf, and dismissed all claims.

Elliott Greenleaf's John G. Dean and Joseph J. Joyce represented the corporate officials in this successful motion for summary judgment.
